Welcome to HomeSetSpace.com (“the Platform,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of this early-access website and any future services provided by the Platform. By accessing or using the Platform, you agree to these Terms.

Because this website is in early access, certain features described here may not yet be active. These Terms outline both current rules and those that will apply when the Platform is fully launched.

 

1. Early Access Notice

This website is currently provided for preview, testing, demonstration, and interest-building purposes only.
Features may change, be added, or removed at any time without notice.
No active bookings, transactions, or contractual services are being performed during this phase.

 

2. Eligibility

To use the Platform, you must:

• Be at least 18 years old

• Be legally capable of entering a binding contract

• Provide accurate information when requested

• Not be banned from using the Platform under these Terms

 

3. Platform Purpose

When fully operational, the Platform will connect:

• Hosts who wish to rent out their space

• Creators who wish to use those spaces to create content

The Platform aims to foster a legitimate, respectful, wholesome, and creativity-focused community.
Users must act in good faith, behave professionally, and use the Platform only for lawful and respectful purposes.

 

4. Communications Through the Platform

Future features may allow users to communicate via messaging tools or booking systems.
Users agree that communications must be:

• Respectful and lawful

• Used solely for legitimate purposes related to booking spaces or creating content

• Not used to bypass platform features, safety measures, or fees

• Free of harassment, solicitation, or abusive behaviour

We may monitor communications for safety, compliance, and fraud prevention.

 

5. User-Generated Content

Users may upload photos, videos, descriptions, or other materials (“User Content”).

By uploading User Content, you confirm that:

• You own it or have the rights to use it

• It does not violate any laws or third-party rights

• It does not contain harmful, illegal, abusive, or explicit material

5.1 License to Use User Content

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display User Content on the Platform

• Use it to operate and improve the Platform

• Use selected User Content for marketing, advertising, promotional materials, social media, example listings, and case studies

We will never sell User Content to unrelated third parties.

You may remove User Content at any time, but previously published marketing materials may continue to exist.

 

5.2 Right to Remove Content and Listings

We reserve the right, at our sole discretion, to remove or delete any User Content, listings, or materials that:

• Violate these Terms

• Pose safety risks

• Are false or misleading

• Are inappropriate, offensive, or unlawful

• Are harmful to platform integrity

We may also block or suspend user accounts for violations.

6. Ownership of Content Created Within Hired Spaces

Creators retain full ownership of the content they produce in a Host’s space (“Created Content”).

• Hosts do not automatically gain rights to Created Content

• The Platform does not claim ownership over Created Content

• Any sharing of Created Content with Hosts requires the Creator’s consent

6.1 Permission for Marketing Use (Optional)

Creators may choose to grant the Platform permission to use their Created Content for:

• Showcasing example shoots

• Highlighting creative work

• Social media and community spotlights

• Marketing, advertising, and promotional campaigns

This permission is optional and will only be used with the Creator’s consent.

6.2 Encouragement to Share (Optional)

Creators are encouraged—but not required—to:

• Share their creative work publicly

• Tag HomeSetSpace on social media

• Use community hashtags or platform features

Creators retain full control over if and how they share their work.

7. Payments and Fees (Future Feature)

Once payment features are activated:

• All payments must occur exclusively through the Platform

• Users may not circumvent or avoid fees by completing bookings off-platform

• Commission rates, payout schedules, and fees will be clearly displayed

• We may temporarily hold funds for verification, security, or fraud prevention

We do not guarantee earnings, bookings, or income for Hosts.

8. Host Responsibilities

Hosts are responsible for:

• Setting their own rates, availability, booking durations, and house rules

• Accurately and honestly describing their space

• Ensuring the space is safe and suitable for creative use

• Responding promptly and respectfully to booking enquiries

8.1 Insurance Requirements

Hosts must ensure they have proper insurance coverage by:

• Informing their home insurer of commercial/creative use

• Confirming their policy permits renting out their space

• Purchasing additional insurance if required

• Or opting into any insurance products the Platform may offer

We are not responsible for losses caused by a Host’s failure to obtain proper insurance.

9. Creator Responsibilities

Creators agree to:

• Use spaces for lawful and respectful creative activities

• Follow Host rules, restrictions, and instructions

• Leave the space in reasonable, clean condition

• Avoid unsafe, abusive, explicit, or illegal activities

• Respect the Host’s property, privacy, and neighbours

Creators may be financially liable for damage they cause.

10. Prohibited Uses

Users may not use the Platform to:

• Avoid platform fees or facilitate off-platform transactions

• Break any laws

• Post or produce explicit, harmful, or abusive content

• Harass or exploit Hosts, Creators, or staff

• Infringe intellectual property

• Upload viruses or malicious code

• Misrepresent themselves or their intentions

• Scrape data or misuse platform technology

 

11. Platform Enforcement Rights

To maintain a safe, wholesome environment, we may:

• Remove listings or profiles

• Delete User Content

• Block or suspend user accounts

• Restrict or limit platform access

• Take action against attempts to circumvent rules or payments

We may take such action at our sole discretion.

 

12. Intellectual Property

All Platform branding, design, software, and content (excluding User Content and Created Content) belong to us.
You may not copy, distribute, modify, reverse-engineer, or commercially exploit any part of the Platform without our consent.

 

13. Privacy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect and process personal data.

 

14. Limitation of Liability

The Platform is provided “as is” and “as available”, especially during early access.

To the fullest extent permitted by law, we are not liable for:

• Service interruptions

• Inaccuracies or technical issues

• Disputes between Hosts and Creators

• Loss of income or opportunity

• Damages arising from your use of the Platform

Your sole remedy for dissatisfaction is to stop using the Platform.

 

15. Changes to These Terms

We may update these Terms at any time.
Continued use after an update means you accept the revised Terms.

 

16. Governing Law

These Terms are governed by the laws of [Insert Jurisdiction].
Any disputes will be resolved in those courts.
