Full Terms & Conditions

1. Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Beachseeker® Media website (“Site”) and all services we provide (“Services”).
By accessing our Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, stop using our Site and Services immediately.

2. Services

Beachseeker® Media provides:

  • Social Media Management

  • Social Media Strategy

  • Content Creation & Curation

  • Reel Production & Short-Form Video Creation

  • Digital Marketing Writing

  • Branding & Consulting

  • Analytics & Reporting

Project scopes and costs will be confirmed in writing before work begins.

3. Use of the Site

You agree not to:

  • Break any applicable laws

  • Upload spam or harmful content

  • Interfere with website functionality

  • Attempt to access restricted systems

Use of the Site for unlawful purposes is strictly prohibited.

4. Intellectual Property

All branding, graphics, text, images, layouts, and digital assets on this Site belong to Beachseeker® Media.
You may not copy, reproduce, or distribute our content without written permission.

5. User-Generated Content

If you submit reviews, testimonials, or other materials (“User Content”), you grant us permission to use them for marketing purposes.
You confirm that you own or have rights to the content you provide.

6. Pricing, Payment & Refunds

6.1 Pricing

All project fees are confirmed in writing before work begins.

6.2 Payment

Invoice payments are due upon receipt unless otherwise agreed.

With a 7 day grace period.

Accepted methods: Bank Transfer or PayPal.

6.3 Late Payments

Any invoice not paid within the 7-day grace period may incur:

  • Interest at 4% above the Bank of England base rate, calculated daily from the due date until payment is received; and/or

  • A reasonable administrative fee to cover the cost of payment recovery.

Beachseeker® Media reserves the right to pause services until outstanding balances are settled.

6.4 Refunds

  • Deposits are non-refundable once work begins.

  • Cancelled projects will be billed for all work completed to date.

  • Digital and creative services are non-refundable once delivered.

7. Scope of Work & Revisions

  • Each deliverable includes up to two rounds of revisions, unless stated otherwise.

  • Additional revisions or changes outside the agreed scope will incur extra charges.

  • Client delays may impact project timelines.

8. Client Responsibilities

You agree to:

  • Provide accurate information

  • Deliver required materials promptly

  • Approve or review work on time

  • Comply with platform rules for all social accounts

Late or missing information may impact results.

9. Third-Party Platforms

We use third-party platforms such as Instagram, Meta, TikTok, Google, and scheduling tools.

We are not responsible for:

  • Platform downtime

  • Algorithm or policy changes

  • Account suspensions or restrictions

  • Quality loss from platform compression

  • Any issues caused by external systems

You are responsible for account access and compliance.

10. Confidentiality

Both parties agree to keep all confidential information private unless:

  • Required by law

  • Necessary to perform the Services

  • Approved in writing by the Client

11. Ownership & Licensing

11.1 Ownership

Final deliverables belong to the Client after full payment.

11.2 Beachseeker Rights

We retain ownership of:

  • Raw footage

  • Drafts, templates, and working files

  • Pre-existing frameworks and intellectual property

11.3 Portfolio Use

We may display finished work in our portfolio unless you request otherwise in writing.

12. Data Protection

We comply with UK GDPR and the Data Protection Act 2018.

13. Disclaimer of Warranties

Beachseeker® Media provides all services “as is”.
We do not guarantee:

  • Specific marketing results

  • Algorithm performance

  • Engagement or sales outcomes

Marketing results may vary due to factors outside our control.

14. Limitation of Liability

Beachseeker® Media is not liable for:

  • Lost profits, revenue, or data

  • Issues resulting from third-party platforms

  • Client-provided content

  • Indirect or consequential damages

Our liability is limited to the total amount paid by the Client in the previous three months.

15. Indemnification

You agree to indemnify Beachseeker® Media against claims arising from:

  • Your misuse of our Services

  • Your breach of these Terms

  • Your content or materials

  • Violations of third-party rights

16. Termination

We may suspend or terminate Services if:

  • Payments are overdue

  • You breach these Terms

  • You engage in abusive or unlawful behaviour

All outstanding fees must be paid upon termination.

17. Force Majeure

We are not responsible for delays or service failures caused by events beyond our control, such as:

  • Illness

  • Technical failures

  • Internet outages

  • Natural disasters

  • Platform malfunctions

18. Content Creation, Filming & Reel Production

18.1 Filming Method

All filming is carried out using an iPhone or similar high-quality mobile device, using the best available settings for social media upload quality.

18.2 Intended Use

Content is produced specifically for social media platforms, not for broadcast, cinema, or commercial television use.

18.3 Quality & Compression

Final delivered content may vary in appearance due to:

  • Lighting or environmental conditions

  • Available filming locations

  • Platform compression and upload limitations

  • Changes to recommended aspect ratios or formats

These factors are outside our control.

18.4 Raw Footage

Raw footage is not supplied unless explicitly agreed in writing.

18.5 Client Requirements

Clients must ensure:

  • Suitable filming locations

  • Necessary permissions

  • Access to relevant accounts

Beachseeker® Media cannot film on private property without permission from the property owner or manager.

19. Changes to These Terms

We may update these Terms at any time. Updated versions will be posted on this page.

Continued use of the Site or Services constitutes acceptance of the revised Terms.
